A. 02.04.2023: SAKVBE Trust, Trustees officially conveyed to the Secretary of SAK Samaj Bangalore about their desire to handover the SAKVBE Trust and its property to SAK Samaj Bangalore.
In this regard SAKVBE Trust, Trustees along with Secretary & Vice-president of SAK Samaj met Trustees and had meeting at SAKVBE Trust plot., Hejalla. Mysore Road. SAKVBE Trust, Trustees informed their desire that will hand over the SAKVBE Trust and Trust property to SAK Samaj Bangalore. Also, they submitted official letter dated 02.04.2023, together with SAKVBE Trust deed copy and property documents. Suggested us to check legal formalities regarding merging it to SAK Samaj Bangalore by consulting Advocate for further steps, advise and procedures. This letter was placed for discussion in the SAK Samaj meeting on 09.04.2023. SAKVBE Trust also invited for this meeting.
B. 09.04.2023: SAK samaj meeting held in SAKSBLR Bhavan, Horamavu along with SAKVBE Truest, Trustees. In the meeting, SAKVBE Trustees in presence of SAK Samaj core members and committee members expressed their wish and decision that SAKVBE Trustees would be handing over SAKVBE Trust and its administration and their property into hands of the Bangalore Samaj. SAKVBE Trustees letter dated 02.04.2023 was taken on record and noted into minutes of the meeting. This move by SAKVBE Trust was welcomed by SAK samaj Bangalore committee members and greeted the trustees that finally they made up their mind to hand over SAKVBE Trust to SAK Samaj Bangalore.
As you all are aware this SAKVBE Trust was one of the branch which was born out of the main root of SAK Samaj Bangalore and with support and assistance of our community members for meeting the educational needs of our community students present throughout Karnataka state.
After detailed discussions consented to merge SAKVBE Trust with SAK Samaj by fulfilling all the procedures and formalities but without any pre-conditions.
C. SAK Samaj Bangalore decided to examine the legal procedures to be followed about taking over the SAKVBE Trust. After legal formalities, SAKVBE Trust will come under SAK samaj Bangalore control and will be run / guided under the instructions of SAK Samaj Bangalore, Education Committee, headed by SAK Samaj Bangalore Samaj Office Bearers and nominated committee members who will be in charge for the administration of running of education committee activities.
D. 11.06.2023: SAKVBE Trustees once again took all the Office Bearers and committed members of SAK Samaj Bangalore to visit the SAKVBE Trust plot at Hejjala Mysore Road. SAKVBE Trustees once again reiterated to merge SAKVBE Trust with SAK samaj Bangalore. Team decided the next steps that to meet LEGAL Expert and execute necessary legal documents such as memorandum of understanding for merging SAKVBE Trust with SAK Bangalore Samaj so that entire control and administration is taken over of SAK Samaj Bangalore. The SAKVBE Trust, Trustees agreed to obtain handover all the documents of SAKVBE Trustees including NOC from their legal heirs, if any.
SAK samaj Bangalore will take over completely the administration of SAKVBE Trust in including plot at Hejjala Mysore road.
E. 25.06.2023: SAK Samaj Bangalore, core committee members met Senior Advocate and consulted the procedures for merger of SAKVBE Trust with SAK Samaj Bangalore. Based on the inputs/instructions given by the Senior Advocate, that as both the organization is a welfare and non-profit organization, merger is permissible/allowed and further there is a provision in both the Byelaws of respective organization for merger and taking over. However, have informed SAKVBE Trustee that the merger of SAKVBE Trust with SAK Samaj Bangalore will be on basis of without any pre-conditions. Further, Senior Advocate has advised to conduct a SAK Samaj Special General Body meeting and pass a resolution to allow this merger to regularize and legalize. This information was conveyed to SAKVBE Trust, Trustee and the same is aligned with them.
